Please find below the Terms and Conditions of Sale. Please read them carefully, as well as Aviso Legal de la Web and Política de Privacidad that govern your browsing of the Website and our relationship with you in the event that you place an order through PROBE BALLOON.

Any order of our products placed through the website will require you to expressly acknowledge and accept these Terms by ticking the box that will appear during the purchase process..

You further acknowledge that such acceptance on the day on which the purchase is made shall imply the application of these Terms to the order placed and your confirmation of purchase shall constitute an electronic contract between you and PROBE BALLOON, and valid evidence between them of the entire order and all amounts due and payable under the order.

PROBE BALLOON’s failure at any time to have recourse to any of these terms and conditions shall not be construed as or amount to a waiver of recourse to them in the future or in the past.

These General Terms and Conditions of Sale shall be valid for an indefinite period of time and shall be applicable to all contracts concluded via the PROBE BALLOON website.

PROBE BALLOON reserves the right to unilaterally modify these conditions, without this affecting products or promotions that were purchased prior to the modification, except in the case of errors.
These Conditions of Sale and the contractual relationship between PROBE BALLOON and the purchaser shall be governed by the provisions of Spanish law. In the event of a dispute, the parties shall endeavour to reach an out-of-court settlement prior to initiating any action in the courts.

Purchase

All products offered on PROBE BALLOON are intended exclusively for persons who are adults (or, if they are minors, are authorised by their legal representative to place an order via the Website); and have full legal capacity to place orders via the Website.

We reserve the right to request from time to time that you provide us with proof of age and/or the authorisation of the above-mentioned legal representative. We reserve the right not to respond to an order and/or to exclude from our database of Customers or potential Customers any Buyer who does not comply with such a request or does not meet the requirements set out in this section.

It is hereby specifically stated that the Products are intended for the personal and private use of the Buyer, which must not be related to his professional activity, including the resale of any Product.

Products

The products offered for sale on the PROBE BALLOON website shall be those displayed on the website on the date on which the customer browses the website.

The Customer is hereby informed that any photographs and texts used to illustrate the Products may vary over time.

Likewise, product information is provided as clearly and simply as possible, so that it is easily understood and assimilated, but we do not guarantee that the quality of the products, information or any other material purchased or obtained on the PROBE BALLOON website will meet the Customer’s personal expectations, as these are subjective in nature.

Size guide

As nobody likes to have to return a garment to change the size and we like that everything fits you perfectly, please consult our size guide ,you will also find it in each product, in it you have information that will help you to find your correct size.

Customer Ratings and Comments

The Customer is authorised to rate and recommend each Product. You can also consult the ratings and recommendations of other users. The ratings and recommendations indicated for each Product reflect the average ratings and recommendations made by those users who responded to each question on their own personal responsibility. Such ratings and recommendations are in no way contractually binding on PROBE BALLOON and may vary from day to day.

Prices and taxes

All prices are quoted in Euros (€) and include Spanish VAT applicable on the date of order.
PROBE BALLOON reserves the right to revise or amend prices at any time. Notwithstanding the foregoing, the Products shall be charged on the basis of the price list applicable at the time the order is placed, except in the case of a computer error. If this error is detected or that there has been an error in the entry of the price of a product after receipt of an order, we will contact you as soon as possible to inform you of the incident, and offer you the option of cancellation or maintenance under the correct conditions. The automatic confirmation remission does not validate erroneous price conditions.

With regard to Value Added Tax (VAT), all companies belonging to countries of the European Union except Spain and which are registered as an intra-community operator and indicate to that effect will be exempt from paying this tax.
Sales to private individuals within the EU are subject to VAT.

VAT will not be charged on sales to any other country in the world. However, the customs systems of each country will apply the corresponding tax charges. In Spain, in the case of the Canary Islands, if the user is identified or indicates their delivery there, the prices are also shown without VAT.
For purchases made from countries outside the European Union (EU), as well as from territories considered to be outside the EU (Canary Islands), all customs clearance costs and import taxes will be borne by the Buyer. Therefore, these costs are not included in the price of the Product, nor in the shipping costs shown on the PROBE BALLOON website.

Payment

The amount to be paid by the Customer shall be the amount indicated in the order confirmation displayed on the website and sent by email to the purchaser by PROBE BALLOON for his information.

The Customer is offered the possibility of choosing between different means of payment on confirmation of their order.

Payments Methods:

– Credit Card (Visa, Visa Electron, MasterCard and Maestro)

The transactions carried out in PROBE BALLOON use the REDSYS platform, a PCI - DSS Level 1 platform, the most advanced certification that encrypts customer card data and stores it in the form of tokens with which it processes operations without having access to card details, reducing the risk of fraud.

– Bizum

PROBE BALLOON offers Clients who have a Bizum account associated with their mobile phone number to pay quickly with all the advantages and security that this system offers.

Shipping

The Products will be sent by post or via a transport/courier service provider. The courier company will make two (2) delivery attempts per order. If the Customer is not at home, the Carrier will leave a delivery notice or contact the Customer, and the Customer will either collect the order from the carrier’s local branch or the Customer will pay the cost of a third delivery directly.
The Customer is advised that any package will be held by the Carrier for a period of seven (7) days from the initial delivery attempt.
On special dates, such as the Christmas period, Black Friday, etc., PROBE BALLOON does not guarantee the delivery of packages. PROBE BALLOON does not guarantee that delivery will be made within the above-mentioned deadlines due to the volume of goods that transport agencies move on these days.
PROBE BALLOON reserves the right to modify delivery times and the type of shipment without prior notice in the case of large orders or special cases.
Right of withdrawal
PROBE BALLOON has an after-sales service to solve any problems with the articles or shipments, through which it tries to offer a fast and efficient service to customers.
If for any reason the Customer is not satisfied with their order, they have a period of 14 calendar days from the day on which the purchaser or a third party indicated by the purchaser, other than the carrier, acquired material possession of the Products ordered to inform PROBE BALLOON.

The transport prices listed below are calculated for shipments up to 1kg.

Shipping costs 8 €
Delivery time: between 1 and 2 working days.

Shipments to Ceuta, Melilla and the Canary Islands (Spain) and shipments to Azores and Madeira (Portugal)

Shipping costs € 12 and € 19 (VAT included)

Approximate delivery time: 3 to 4 working days for Ceuta, Melilla and the Canary Islands and 5 to 8 days for Azores and Madeira.
In purchases for Ceuta, Melillas and the Canary Islands, VAT is not applied and the system will automatically eliminate it in the purchase process once the Customer has indicated the shipment to those destinations. In the same way, the invoice will also be issued without VAT.
PROBE BALLOON is not responsible for taxes or other charges that residents of Ceuta, Melilla or the Canary Islands must pay. These expenses are external to PROBE BALLOON and will always be paid by the recipient Client.

Europe Shipments

Europa 1 (Germany, France, Belgium, Luxembourg, Netherlands): 20€. (VAT included)

Europa 2 (Italy, United Kingdom, Ireland, Denmark, Austria, Poland, Czech Rep., Hungary, Slovakia, Slovenia): 22€ (VAT included)

Europa 3 ( Sweden, Croatia, Estonia, Lithuania, Latvia ): 37€. ( VAT included )

Europa 4 ( Finland, Greece, Bulgaria, Romania ): 40€. ( VAT included )

Switzerland: 45€  ( VAT included )

Norway, Bosnia and Herzegovina: 58€.  ( VAT included )

Serbia and Montenegro: 68€ ( VAT included )

PROBE BALLOON is not responsible for customs costs and / or charges of any kind inherent to purchases from these places that the Local Authorities decide to place and that will be borne by the Client-recipient. Nor is it responsible in the event that the Local Authorities decide to confiscate any item contained in a shipment.

Deliveries to other countries

Customers from other countries who wish to place an order can contact PROBE BALLOON by e-mail at info@probeballoon.com to agree on how to place the order, the conditions and the method of delivery.
In all the above cases, the delivery costs will be shown before completing the purchase process and will be calculated according to the destination of the order and the cost of the order.
Can I track the status of my order?
Yes, you can track your order at any time, from the confirmation of the purchase until the delivery of the same, either from the “Order Tracking” area or through a link to the page of the transport company included in the confirmation email, depending on the characteristics of the shipment.

Right of withdrawal

PROBE BALLOON has an after-sales service to solve any problem with the articles or shipments, through which it tries to offer a quick and efficient service to customers.
If for any reason the Customer is not satisfied with their order, they have a period of 14 calendar days from the day on which the purchaser or a third party indicated by the purchaser, other than the carrier, acquired material possession of the Products ordered to inform PROBE BALLOON.

Notice of withdrawal

In order to exercise the right of withdrawal, the Buyer must notify us of his decision to withdraw from the contract by means of an unequivocal statement (e.g. letter sent by post or e-mail) to the following address:PROBE BALLOON, Plaza del Ayuntamiento, 5, piso 8, pta 23 – 46013 Valencia (Spain) or by email to info@probeballoon.comPara comply with the withdrawal period, it is sufficient that the communication concerning the exercise of this right is sent before the relevant period expires.

Consequences of withdrawal

In the event of withdrawal, PROBE BALLOON will refund all payments received from the customer, including the initial delivery costs (with the exception of the additional costs resulting from the customer’s choice of a delivery method other than the least expensive standard delivery method offered by us) without undue delay and, in any event, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. PROBE BALLOON shall proceed to effect such reimbursement using the same means of payment used by the Customer for the initial transaction, unless it has expressly provided otherwise in the notice of withdrawal; in any event, the Customer shall not incur any costs as a result of the reimbursement. However, PROBE BALLOON may postpone the reimbursement of the amount in question until the Products being returned have been effectively taken back. Legal guarantees

PROBE BALLOON shall be required to deliver a Product in conformity with the order placed by the Customer and shall be liable for any lack of conformity that may exist upon delivery of the Product. Similarly, PROBE BALLOON is obliged to guarantee all items sold with regard to any hidden defects which may render them unfit for their intended purpose or which may restrict their use in such a way that the Customer would not have purchased them (or would have done so, but at a lower price) had he/she been aware of such defects. If the lack of conformity of the Product(s) is confirmed or the existence of hidden defects is determined the Customer shall have the option to arrange for the replacement of the Product(s), in accordance with the stated cost requirements.
